چکیده

هدف از مقاله حاضر که به شیوه اسنادی صورت گرفته، بررسی سازوکارهای ملی و بین‌المللی اعمال حق تصحیح و مشخص کردن برخی از ایرادها و نقدهای وارد شده به آنهاست.حق پاسخ و تصحیح اخبار و گزارش‌ها و مطالب نادرستی که از سوی مطبوعات و رسانه‌های پخش (رادیو و تلویزیون) انتشار می‌یابد و به حیثیت و اعتبار اشخاص حقیقی و حقوقی لطمه وارد می‌کند، در ایران نیز مانند سایر کشورهای جهان مورد توجه قرار گرفته و قوانینی برای تحقق آن به تصویب رسیده است که با وجود مشکلات متعدد، گامی مثبت در جهت حمایت از حقوق مخاطبان و روشی مناسب برای دفاع از حیثیت و شرافت افراد تلقی می‌شود. اما سازوکارهای بین‌المللی حق تصحیح بویژه سازوکار ارسال اطلاعیه که در کنوانسیون بین‌المللی حق تصحیح پیش‌بینی‌شده ناکارآمد و فاقد ضمانت اجرایی لازم است. از این رو، تصویب مقررات جهانی کارآمدتر برای اعمال حق تصحیح مانند نوعی سازوکار کنترل بین‌المللی، بر اساس اصل الزام دولت‌ها به اعلان و انتشار تخلفات امری ضروری است.

چکیده [English]

The present article aims to explore national and international mechanisms of using Rights of Correcting faults and tackling criticisms.
The right of reply and correcting news and reports and false accusations on part of press and broadcasting media (television and radio) which tarnishes individuals reputations at both legal and personal levels, has drawn attention in Iran as in other countries and there have been rules adopted in this regard. Despite various problems, such an adoption is a progressive step towards supporting audience rights and defending individuals’ reputation and dignity. However, international mechanisms of Right of Correction, particularly the mechanism of sending announcement which is predicted in the International Convention of Right to Correction, are ineffective and lack proper implementation guarantee. Thus, adoption of more effective international regulations for exercising the Right of Correction, i.e. some sort of international control mechanism, based on the “principle of governments commitment to announcement of infringement, is a necessity.
